Terms of Service

These Terms of Service ("Terms") govern your access to and use of MyURLMonitor (the "Service"), operated by Cubiclefreed LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service is offered exclusively to businesses, freelancers and other professional users acting for purposes related to their trade, business or profession. It is not offered to consumers. By using the Service, you confirm that you are acting in a professional capacity.

If you accept these Terms on behalf of a company or other organization, you confirm that you have authority to bind it, and "you" refers to that organization.

MyURLMonitor helps you monitor the Google indexing status of your website's pages and submit pages to Google. It uses Google Search Console and Google indexing APIs, among other data sources.

Google alone decides whether, when and how pages are crawled, indexed or ranked. We do not guarantee that any URL you monitor or submit through the Service will be crawled, indexed, remain indexed, or rank in search results. Indexing status data is provided as reported by Google and third-party sources and may be delayed or inaccurate.

You must be at least 18 years old to use the Service. You are responsible for keeping your login credentials secure and for all activity under your account.

If you invite team members or viewers, you are responsible for their use of the Service and for their compliance with these Terms. You control which websites they can access.

You agree that you will:

• Only add websites and submit URLs for properties you own or are authorized to manage
• Not submit spam, doorway, deceptive, malicious or illegal URLs or content
• Not submit URLs, sitemaps or other content containing personal data of third parties
• Not use the Service to violate Google's terms of service or API policies
• Not attempt to circumvent usage limits, rate limits or security measures, or access the Service by automated means other than features we provide
• Not resell or provide the Service to third parties except through the features of your plan

The Service depends on APIs and services provided by Google and other third parties. Their availability, quotas and terms are outside our control and may change at any time. If a third party changes, restricts or discontinues access, or if we believe continued use of a feature may breach a third party's terms, we may modify, limit or suspend the affected features without liability.

If you connect your own Google service account or Google Cloud project, you are responsible for that project and its compliance with Google's terms. You must keep any credentials you provide valid and secure.

Paid plans are billed on a subscription basis. Subscriptions are sold through Stripe's Link service, which acts as the merchant of record and reseller. Payment is processed under the payment terms shown at checkout. Charges appear on your statement as "LINK.COM* MYURLMONITOR" or similar.

Prices on our website are shown excluding VAT and other applicable taxes. Taxes are calculated and collected by the merchant of record at checkout.

We may change prices with at least 30 days' notice. Price changes take effect at the start of your next billing period after the notice period. If you do not agree to a price change, you can cancel before it takes effect. Plans sold with a locked or guaranteed price keep that price for the period stated at purchase.

You can cancel your subscription at any time in your account settings or through Link. Cancellation takes effect at the end of your current billing period, and you keep access to paid features until then. Cancelling your subscription does not delete your account.

You can delete your account in your account settings. When your account is deleted, we delete your data as described in our Privacy Policy. Deleted data cannot be recovered.

Monthly subscriptions are not refunded for partial months. For annual subscriptions, we may issue a prorated refund at our discretion if you cancel within the first 30 days. Because payments are handled by the merchant of record, refunds may also be issued under its policies.

We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if your use creates a security, legal or abuse risk, or as described in Section 7. We may also discontinue the Service with at least 30 days' notice, in which case we will refund any prepaid fees for the unused period.

You retain all rights to the data and content you submit to the Service. You grant us a non-exclusive, worldwide, royalty-free license to host, process and use that content solely to provide, maintain and improve the Service for you. You confirm that you have the rights needed to grant this license.

We may use aggregated and anonymized data that does not identify you or your websites to operate and improve the Service.

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable during maintenance or because of events outside our control.

The Service and its software, design, content and features are owned by Cubiclefreed LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or other intellectual property beyond using the Service as permitted here.

You will defend, indemnify and hold harmless Cubiclefreed LLC from any claims, damages, losses and expenses (including reasonable legal fees) arising from the websites, URLs and content you submit, your use of the Service in breach of these Terms, or your violation of any law or third-party terms, including Google's.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by law, Cubiclefreed LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, traffic, search rankings, data or goodwill, arising from or related to the Service.

Our total liability for all claims arising from or related to the Service or these Terms is limited to the greater of (a) the fees you paid for the Service in the 12 months before the event giving rise to the claim, or (b) USD 100.

These limitations do not apply to liability that cannot be limited under applicable law, such as liability for intent or gross negligence where such laws apply.

We may update these Terms from time to time. For material changes, we will notify you by email or through the Service at least 30 days before they take effect. If you continue to use the Service after the changes take effect, you accept the updated Terms. If you do not agree, you can cancel your subscription and stop using the Service.

Our Privacy Policy and Cookie Policy explain how we handle personal information and cookies, and are incorporated into these Terms by reference.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Any dispute arising from or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Wyoming, and both parties consent to the jurisdiction of those courts.

These Terms are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
